Access to this Website is permitted on a temporary basis. We reserve the right to withdraw or amend the services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts, or all of the Website.
Your purchase from the website indicates that you have had sufficient opportunity to access the Terms and contact us with any questions, that you have read, accepted and will comply with the Terms, and that you are eighteen (18) years or older, or have the consent of a legal guardian who is eighteen (18)
years or older.  You must not order products or services from us if you are under eighteen (18) years of age or do not have the consent of a legal guardian who is eighteen (18) years or older. If you do not agree to these Terms and Conditions, please do not use our website.

BUSINESS POLICY
The items are intended to be sold to legal persons, who are purchasing upon personal needs (hereinafter referred to as the “Customer”).
The Customer, therefore, agrees to act as a Customer and not purchase with the intention of using the items for commercial purposes such as reselling, putting the items up for rent, etc.

 

PRODUCTS

1. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. The Customer understands that there may be slight differences in colour, due to the different colour settings in different monitors/screens.
2. If the ordered product is handmade, or contains handwork, the Customer understands that the product cannot be recreated in a completely identical way, as it’s done by hand and not by machine.   
3. While we make all reasonable efforts to keep our stock quantities as up-to-date as possible on the website, stock quantities are not updated in real time. This means that on some limited occasions items become unavailable in the warehouse shortly thereafter and before your order is fulfilled. If a sold-out item is purchased, you will be notified by e-mail as soon as possible and offered a refund or suitable replacement. If your order is cancelled by us in these circumstances, we will refund in full all amounts you have paid in respect of such unavailable product (and any relevant shipping costs). We reserve the right to limit the sale of products to reasonable or normal household quantities. We reserve the right to cancel or reject orders for quantities where we suspect that the purchaser is purchasing for resale and not for personal use.

ORDERING PROCESS
We reserve the right to accept or reject an order for any reason, including due to unavailability of product, an error in the price of an individual product, image or the product description, error in your order, an inability to adequately verify the purchaser details, or if the credit or debit card issue does not authorise the transaction. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

PAYMENT
 All prices are quoted in, and orders are calculated, in Australian Dollars (AUD). To place an order/purchase an item, the Customer must pay the full price of a product.
The payment(s) must be done through MasterCard, Amex, Visa and PayPal and we reserve the right to vary our accepted payment methods at any time without notice.

We use a reputable third-party payment processor to process payments and do not collect or store credit card details. Regarding your purchase details, we will use all reasonable steps to protect your data in line with our privacy obligations (see our Privacy Policy); however, in the absence of negligence, we will not be responsible for any loss or damage that you may suffer if a third party acquires unauthorised access to data that you have provided to us.

ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that
all information in the Service or on any related website has been modified or updated.

TITLE
Title in the products will not pass to you until the later of delivery or when your payment has been processed or otherwise received by us. If your payment is declined or reversed for any reason we reserve the right to reclaim the products from your possession, custody or control even if they have been delivered to you or moved from the delivery address. We reserve the right to keep or sell the
products. Risk of loss, damage or deterioration to any products will pass to you on delivery to your nominated address. It is your responsibility to ensure that you enter delivery address details correctly.

INTELLECTUAL PROPERTY POLICY
The Customer shall not reproduce, represent, distribute or adapt, directly or indirectly, any exclusive content pertaining to FARACHI including trademarks, illustrations, photographs, videos, and designs in any way, shape, or form, without prior written consent from FARACHI.
